A recent Department of Defense instruction alters the US code applying to the military’s involvement in domestic law enforcement by allowing US troops to quell “civil disturbances” domestically without any Presidential authorization, greasing the skids for a de facto military coup in America along with the wholesale abolition of Posse Comitatus.
The instruction (embedded at the end of this article), which was originally released in February yet has only come to light this week, outlines DoD policy regarding, “DoD support to Federal, State, tribal, and local civilian law enforcement agencies, including responses to civil disturbances within the United States.”
On page 16 of the document (PDF), we find the following amendment (emphasis mine);
(3) When permitted under emergency authority in accordance with Reference (c), Federal military commanders have the authority, in extraordinary emergency circumstances where prior authorization by the President is impossible and duly constituted local authorities are unable to control the situation, to engage temporarily in activities that are necessary to quell large-scale, unexpected civil disturbances because:
(a) Such activities are necessary to prevent significant loss of life or wanton destruction of property and are necessary to restore governmental function and public order; or,
(b) When duly constituted Federal, State, or local authorities are unable or decline to provide adequate protection for Federal property or Federal governmental functions. Federal action, including the use of Federal military forces, is authorized when necessary to protect Federal property or functions.
On page 17 of the document, a number of different scenarios are listed under which the military is forbidden involvement, although the broader power of quelling domestic disturbances without presidential or congressional authorization is claimed. More…

Invasive “crazy ants” are displacing fire ants in areas across the southeastern United States, according to researchers at The University of Texas at Austin. It’s the latest in a history of ant invasions from the southern hemisphere and may prove to have dramatic effects on the ecosystem of the region.
The “ecologically dominant” crazy ants are reducing diversity and abundance across a range of ant and arthropod species — but their spread can be limited if people are careful not to transport them inadvertently, according to Ed LeBrun, a research associate with the Texas invasive species research program at the Brackenridge Field Laboratory in the College of Natural Sciences
The study by LeBrun and his colleagues was published in Biological Invasions.
“When you talk to folks who live in the invaded areas, they tell you they want their fire ants back,” said LeBrun. “Fire ants are in many ways very polite. They live in your yard. They form mounds and stay there, and they only interact with you if you step on their mound.”
LeBrun said that crazy ants, by contrast, “go everywhere.” They invade people’s homes, nest in crawl spaces and walls, become incredibly abundant and damage electrical equipment.
The crazy ants were first discovered in the U.S. in 2002 by a pest control operator in a suburb of Houston, and have since established populations in 21 counties in Texas, 20 counties in Florida, and a few sites in southern Mississippi and southern Louisiana. More…

MINEOLA, N.Y. — Officials say a New York college student was accidentally killed by a police officer as she was held in a headlock by an intruder pointing a gun at her head during a break-in at an off-campus home.
Nassau County police said Hofstra University junior Andrea Rebello was killed after being shot in the head when police responded to a break-in early Friday.
Police say Dalton Smith was holding a loaded gun to Rebello’s head after entering the home looking for valuables.
Police say an officer fired eight shots at Smith after he pointed his weapon at the officer, hitting him seven times and killing him.
The shooting came just days before the school’s commencement ceremonies, which are scheduled to take place Sunday. More…

Seeking to keep pace with changing technology, Illinois toughened penalties Saturday for those who use social media and text messaging to organize violent “flash mobs” like those that have occurred on Chicago’s Michigan Avenue and in other tourist areas.
Gov. Pat Quinn signed legislation doubling the maximum prison term for offenders to six years. The legislation was in direct response to recent incidents in downtown Chicago that left business owners fearful that tourists and other visitors would be scared off. Bill sponsor Rep. Christian Mitchell, D-Chicago, has said it will also make neighborhoods throughout the state safer.
“Nobody should have to worry about a violent mob attack when going about their daily lives,” Quinn said in a written statement, calling the use of technology to organize such action a “troubling trend.”
Police say groups of young people used Facebook and Twitter, as well as text messaging, to organize and publicize a mob action along Michigan Avenue in March. They say several hundred people — most of them teenagers — ran up and down the upscale shopping area, yelling and bumping into people. More…

THOUGH YOU wouldn’t know it from the mainstream media, the U.S. economy continues to suffer the aftershocks of the Great Recession of 2008. California is special case in point, where the unemployment rate hovers at 10 percent.
To resolve this crisis, money-grubbing corporations and the politicians that serve them are working together to restructure the economy and restore stronger growth by turning to resource extraction. This form of growth and development is already having a drastic impact on the environment, people’s health–and also the sovereignty and rights of Native American tribes and nations.
The consequences for working people are stark. In California, child poverty is on the rise at 23 percent, rental prices have skyrocketed, migration to the Golden State has slowed, and in a sure sign of an unfolding social crisis, some adults are deciding that having children is no longer an affordable option. The reports of a rise in suicide rates among adults shows how far the social crisis can deepen if people don’t have access to economic stability and good jobs.
In the fall of last year, Native tribes declared a state of emergency. Reports revealed Native American teens and young adults are killing themselves at more than triple the rate of other young Americans. Coming after decades of racism, continued land theft and inequality, Native Americans, as a segment at the bottom of the ladder, are being hit the hardest. More…

When it comes to swine flu, elephant seals can now be included in the list of carriers. According to a new UC Davis study, the marine mammals distinctive for their honking noses contracted the H1N1 virus back in 2010, just as the pandemic caused by the virus was winding down in humans.
Influenza virus is famous for its ability to cross species barriers, and this isn’t the first time a marine mammal has been found to carry a human strain, said lead author Tracey Goldstein, an associate professor with the UC Davis One Health Institute and Wildlife Health Center. Yet, she said, researchers had never found a human pandemic strain in marine mammals before.
The study was published Wednesday in the online journal PLOS ONE.
In 2009, the H1N1 virus started a worldwide influenza outbreak and ultimately killed as many as half a million people worldwide. The highly contagious infection was a new version of the flu, cobbled together with pieces of human, swine and bird viruses. Although the virus has been found in a few other species — ferrets, cats, dogs and a cheetah — unlike other influenza viruses the risk of H1N1 infection between species isn’t well-documented, according to the federal Centers for Disease Control.
“Most of the other viruses that we see in marine mammals tend to be more linked with bird influenzas, and I think that was the surprise,” Goldstein said. “Where did this human one come from?” More…

— The Obama administration on Thursday issued a new set of proposed rules governing hydraulic fracturing for oil and gas on public lands, moving further to address industry concerns about the costs and reporting burdens of federal regulation.
The new Interior Department proposal, which is subject to 30 days of public comment and further revision, disappointed environmental advocates, who had pushed for full disclosure of the chemicals used in the drilling process and tougher standards for groundwater protection and well integrity.
The new rule allows oil companies to keep some components of their drilling fluids secret and will allow them to run well integrity tests on one representative well rather than all wells in a field where the geology and well construction techniques are similar.
The proposed regulation, which revises one proposed a year ago, also allows drillers to comply with state regulations in places where federal officials deem them as tough or tougher than the applicable federal rules. More…

The latest in financial innovation is coming from Nigeria–and it blessedly doesn’t involve elaborate Internet scams.
Nigeria’s government, instead, is teaming up with MasterCard to run a pilot program which would turn the country’s national ID cards into debit cards.
MasterCard and the Nigerian National Identity Management Commission made the government debit card announcement at the World Economic Forum on Africa on Wednesday. 13 million combination government ID cards/debit cards will be rolled out over the next year; Nigeria has a population of approximately 167 million. The ID cards, which contain demographic and biometric data belonging to each Nigerian citizen encoded on a microchip, will be linked to bank accounts. When the cards are used at stores or kiosks, cashiers will be able to verify the buyer’s identity using both the regular photo identification and the biometric chip-encoded information. More…

Activist Amy Meyer recently made news in Utah for being charged with violating Utah’s now infamous “ag-gag” law that prohibits the filming of farm and agricultural operations, even if doing so documents illegal animal abuse. The charges against Meyer were dropped but local activists have not dropped the issue and are rallying Saturday to protest the law.
Activists say Meyer’s “crime” was compassion when, from a public area, she began recording alleged animal abuse at the Smith & Sons Meatpacking and Slaughterhouse in Draper, and was subsequently charged under Utah’s ag-gag law, a law activists say gives companies a veil of secrecy they can use to abuse animals and allow for unsafe practices and dangerous contaminants to enter the food Utahns eat. Witnesses rush to help those pinned underneath a car after it ploughs through a parade, injuring dozens.
Up to 60 people were injured when a car drove into a parade in a small Virginia mountain town.
Witnesses immediately ran over to lift up the 1997 Cadillac to help free a woman trapped underneath it.
Three of those hurt were airlifted to hospital by helicopter. Another 12 to 15 were taken by ambulance and the rest were treated at the scene by paramedics.
Washington County director of emergency management Pokey Harris said no fatalities had been reported and that the injuries ranged from critical to superficial.
Witnesses described the driver of the car as an elderly man and said the vehicle had a disabled parking sticker on it.
What caused the car to drive into the crowd was not immediately known.
An investigation has been launched and it is thought the motorist may have suffered a medical emergency before the accident, causing him to lose control of the vehicle. More…
